That’s a pretty loose interpretation of “punishment.” This is exactly what libertarians mean when they speak of a “monopoly on violence.” If you and I were to drag anyone out of their car and beat them senseless, wether they were drunk or no, we would surely be sitting in jail. A government parasite, on the other hand, enjoys some nice time off from work.
